Refund policy

Article 1 – Definitions

In these terms, the following definitions apply:

• Cooling-off period: the period within which the consumer can exercise their right of withdrawal;

• Consumer: the natural person who is not acting in the exercise of a profession or business and enters into a distance contract with the entrepreneur;

• Day: calendar day;

• Extended-duration transaction: a distance contract relating to a series of products, the delivery and/or purchase obligation of which is spread over time;

• Durable medium: any means that enables the consumer or entrepreneur to store information personally in a way that allows future consultation and unaltered reproduction of the stored information;

• Right of withdrawal: the option for the consumer to withdraw from the distance contract within the cooling-off period;

• Entrepreneur: Fornello B.V., established at Lindenlaan 36, 3737 RD Groenekan;

• Distance contract: a contract in which distance communication techniques are used;

• Distance communication technique: a means that can be used to conclude a contract without the consumer and entrepreneur being physically present at the same time.

Article 3 – Applicability

1. These general terms and conditions apply to every offer from Fornello and to every distance contract concluded between Fornello and the consumer.

2. Before the distance contract is concluded, the text of these general terms and conditions is made available to the consumer. If this is not possible, Fornello will indicate how the terms can be inspected or will send them free of charge on request.

Article 4 – The offer

1. The offer contains a complete and accurate description of the products offered. Obvious mistakes or errors do not bind Fornello.

2. Images are a truthful representation of the products offered. Colours may differ slightly in reality.

3. Each offer clearly states the rights and obligations attached to acceptance.

Article 5 – The contract

1. The contract is concluded at the moment the consumer accepts the offer and meets the conditions set out therein.

2. If the contract is concluded electronically, Fornello takes appropriate technical and organisational measures to secure the electronic transfer of data.

3. Fornello will provide the following information with the product:

   • Fornello's visiting address;

   • the conditions for using the right of withdrawal;

   • information about warranties and service;

   • the contact details for handling complaints.

Article 6 – Right of withdrawal

1. The consumer has the right to withdraw from the contract within 30 days of receiving the product.

2. During the cooling-off period, the consumer will handle the product and packaging with care. Returns should be made in original condition as far as possible.

3. To exercise the right of withdrawal, the consumer can use the European model withdrawal form, or contact us within 30 days of receipt via support@fornello.eu. After that, the consumer has a further 14 days to return the product.

Article 7 – Return costs and refunds

1. Upon withdrawal, Fornello refunds the full purchase amount including shipping costs.

2. Returning items is free. The consumer receives a return label.

3. Refunds are made within 14 days of receiving the returned product or proof of shipment.

Article 8 – Exclusion of the right of withdrawal

Exclusion of the right of withdrawal is only possible for products:

• that spoil quickly or have a limited shelf life;

• that cannot be returned for reasons of hygiene or health and whose seal has been broken.

At Fornello this applies to food items, such as bread mixes and the sourdough starter, whose packaging or seal has been opened.

Article 9 – Prices

1. All prices include VAT.

2. Fornello reserves the right to adjust prices as a result of changes in VAT rates or obvious errors.

3. As long as the contract has not been concluded, Fornello is not bound by incorrect price listings.

Article 10 – Conformity and warranty

1. Fornello guarantees that the products comply with the contract, the description in the offer and the legal requirements.

2. All products come with a 2-year warranty against manufacturing defects.

3. In the event of a defect within the warranty period, Fornello offers free repair, replacement or a full refund.

4. If you register your product via the QR code in your recipe book or on our warranty registration page, you get 1 extra year of warranty, 3 years in total. The full terms can be found in our warranty terms.

5. This warranty does not affect the consumer's statutory rights.

Article 11 – Delivery

1. Orders are delivered from Monday to Saturday.

2. If you order on working days before 17:00, your order will be shipped the same working day and you will have it delivered within 1 to 2 working days.

3. Fornello ships within the Netherlands, Belgium and other EU countries.

4. If delivery is delayed, you will be informed within 48 hours. You then have the right to cancel the order free of charge.

Article 12 – Payment

1. Payment is made in advance via the payment methods offered by Fornello (including iDeal, PayPal).

2. If payment is not received, Fornello reserves the right to cancel the order.

Article 13 – Complaints procedure

1. Complaints about the performance of the contract must be reported as soon as possible, but no later than within 2 months of discovery, via support@fornello.eu.

2. You will receive a substantive response within 14 days.

3. If a complaint cannot be resolved by mutual agreement, it can be submitted to a disputes committee or the competent court.

Article 14 – Disputes

1. Dutch law applies exclusively to contracts between Fornello and the consumer.

2. Disputes can be submitted to the competent court in the Netherlands.
